General terms and conditions of the MM Scavia online shop

1. Assortment, delivery quantities and subscriptions

These general terms and conditions (GTC) are valid for all transactions relating to the order and purchase of goods or services through the online shop www.mmscavia.com, managed by MM SCAVIA WINERY SA, Via Zurich, 5 – Lugano (CH).
On www.mmscavia.com MM Scavia offers wines in normal commercial quantities and services related to individuals domiciled in Switzerland for private consumption. The delivery area is limited to Switzerland and the Principality of Liechtenstein. Orders can be made up to a maximum of 10 days from the date of delivery (except for wines in subscription). The minimum amount of the order amounts to fr. 50.
The assortment of www.mmscavia.com may differ from the range of products that MM Scavia offers in its local sales outlets and may also differ from region to region depending on the delivery area. The information published on these wines is not binding, with the exception of the identification data of the producer and the vintage of the wine

2. Stipulation of the contract / withdrawal / defects

The order for the customer is binding when the online ordering process ends with the confirmation “Order now”. Subsequently the customer can no longer change the contents of the order.
At the end of the ordering process, the customer immediately receives an acknowledgment of receipt of the order by e-mail.
During the Customer Service opening hours, the entire order can be canceled, provided this is done 36 hours before the agreed delivery time. An order is considered canceled when it is confirmed by Customer Service. It is not possible to cancel an online order. Any defects in the goods or incorrect deliveries must be challenged by the customer immediately upon receipt of delivery. Otherwise the delivered goods are considered void and accepted by the customer. The hidden defects must be challenged in writing immediately after being detected. Unless otherwise stated, defective goods must be retained until returned and can not be consumed.

3. Time and method of delivery

In the order the customer can choose one of the proposed delivery dates. The first possible delivery date is the third working day following the receipt of the order (excluding the latter). No contact is made on national, regional or local holidays.

The times offered are only indicative. Failure to comply with the delivery time does not authorize the customer to withdraw from the contract or request compensation. If, for reasons not attributable to MM Scavia (eg incorrect delivery address, absence of the recipient, lack of authorization to access by means of transport, bad weather conditions or traffic problems, etc.) it is impossible to make a delivery or it is possible to carry it out with difficulty, MM Scavia has the right to cancel the order. In such cases it is absolutely excluded any right of the customer to indemnify or refund the real value of the goods.

4. Price and delivery costs

Normally the price of a wine corresponds to the price of the product as it is displayed in the local sales points, without delivery. However, there may be differences. Not all wines that can be purchased locally in the sales outlets are available on www.mmscavia.com and vice versa. The prices published on www.mmscavia.com are applied at the time of ordering. Prices, inclusive of the value added tax applicable by law, are shown in Swiss francs.

Detection and security of customer data
During visits to the online shop www.mmscavia.com cookies are set and Webtrends and Tealeaf web analysis tools are used. Both these tools detect the IP address, time and duration of the visit, operating system, browser and pageviews. 6. Link with the online shop and links to other websites
All customers of www.mmscavia.com have the possibility, before the conclusion of the order, to change online shops and to add to their cart products of the proposed range on www.mmscavia.com. In this way it is possible to integrate the products of both online shops into one order and delivery. In this case, depending on the product, the general conditions of www.mmscavia.com and www.coopathome.ch apply to the conclusion of the contract.

7. Applicable law and jurisdiction
Only Swiss law is applicable. The place of jurisdiction is Lugano or the customer’s place of residence.
